Introduction
The general conditions of sale (the "GTC") detailed below apply to all product orders placed via the website www.moft-bijoux.com of the company BORGO, 1 Avenue Simon Vouet, 78560 Le Port Marly by the customer. The customer must read the T&Cs prior to any order, the T&Cs being available on the site. Consequently, the fact of placing an order on our site reflects the full prior and unreserved acceptance of the GCS by the customer.
Product
The products offered for sale are those appearing on the site on the day of its consultation by the customer. The Products are described and presented with the greatest possible accuracy. MOFT cannot be held responsible in the event of minimal variation between the products and the presentation made of them on the site. MOFT undertakes to deliver products that meet the requirements in force relating to the safety and health of persons in accordance with European provisions, and in particular the legislation on chemical substances with regulated content.
Ordered
Order taking on the site is subject to compliance with the procedure set up by MOFT on the site comprising successive stages leading to the validation of the order. The customer can select as many products as he wishes which will be added to the basket. The basket summarizes the products chosen by the customer as well as the prices and costs relating thereto. The customer can freely modify the basket before confirming his order. The validation of the order is worth confirmation of the acceptance by the customer of the GTC, the products purchased, their price as well as the associated costs. Placing an order on behalf of another person without their consent or placing an order that could cause economic damage to MOFT will be the subject of a police report. MOFT reserves the right to change prices at any time or to correct incorrect prices. If a price was incorrectly stated, MOFT will be obliged to cancel the order and refund the contributions to the best of its ability. This can happen at any time. A confirmation email summarizing the order (product(s), price, availability of the product(s), quantity, etc.) will be sent to the customer. To this end, the customer formally accepts the use of electronic mail for confirmation by MOFT of the content of his order.
All orders are shipped from France. For this reason, there are no customs duties or import taxes within the EU.
All orders outside the EU may be subject to customs duties, import taxes. These additional costs must be paid by the customer.
Customs charges go 100% to customs in the destination country and are the responsibility of the customer. MOFT has no control over these charges and cannot estimate their amount.
It is not possible to receive the order until the customs fees have been paid.
If for any reason customs fees are not paid, your package will be returned to us. In case of return of the package, the customs fees as well as the return costs which have been generated will be deducted from the amount which will be refunded to you.
Confirmation
As soon as the order has been placed, the customer will receive a confirmation e-mail including an electronic invoice. Thus, it is important that you provide us with a valid email address during the purchase process. We advise you to register the email address with which you placed an order in order to facilitate contacting our customer service in the event of a request. Your confirmation email also serves as proof of purchase. (supporting document)
Payment
Payment is made online at the customer's choice: by Paypal or by credit card. All credit card payments are made via the secure platform of our payment provider Stripe. MOFT does not process any credit card data.
Payment by credit card
The cards accepted are: Visa, Mastercard. All purchases made on the site are protected and secure 7 days a week and 24 hours a day. Bank details are transmitted in encrypted mode to our service provider Stripe. When paying, the customer indicates his card number, its expiry date and the cryptogram appearing on the back of his bank card. This data is automatically transmitted in encrypted mode to be verified in order to prevent abuse and fraud. MOFT does not charge any additional fees for payment by credit card. However, depending on the type of card used, your bank may apply a surcharge. By clicking on Paypal, the Customer's financial information is never communicated to the seller. PayPal encrypts and protects your card number once and for all. The Customer pays online by simply indicating his email address and password.
Price
The prices of the products are those appearing on the site www.moft-bijoux.com on the day of its consultation by the customer. The prices of the products are indicated in euros and include VAT. Please note, in the event of delivery to an address outside the EU, customs duties and taxes may apply when the product arrives at its delivery address. These amounts are then to be paid by the customer. Please be aware that MOFT has no way of controlling these additional costs which may vary from country to country. For more information please contact your customs office. The products remain the property of the seller until full receipt of the price by the seller.

Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good. To exercise his right of withdrawal, the customer must notify the seller (MOFT, 1 avenue Simon Vouet, 78560 LE PORT MARLY, FRANCE, contact@moft-bijoux.com) of his decision to withdraw the order by means of a declaration without ambiguity (eg letter sent by post, e-mail). The Customer may use the model withdrawal form or any other unambiguous statement and send it to the following address: contact@moft-bijoux.com. The sending of the withdrawal within a given period is sufficient to respect the said withdrawal period. After these deadlines, the items delivered will be deemed accepted by the customer.
A bundle is a set of two or more products that are sold as a single product and can therefore only be returned together. Therefore, in case of returning the bundle, please return all items contained in the bundle as well.
Items excluded from redemption: gift wrap, gift cards.
Please note that the warranty does not cover gift items such as freebies as part of special offers.
Consequences of the right of withdrawal
You must return or return the goods without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract to us. This period is deemed to have been complied with if you return the goods before the expiry of the period of fourteen days.
For more convenience, we offer you a right of return extended to 30 days from receipt of the order.
Following the retraction
If the customer has already received his order: in the event of withdrawal by the customer, the seller will reimburse him for all payments received for the order, including delivery costs (with the exception of additional costs if the customer has chosen a delivery other than the standard delivery method offered by the seller) without undue delay and in any event, no later than 14 (fourteen) days from the day on which the seller is informed of the customer's decision to withdraw from his order. We will make the refund via the payment method you used when purchasing, unless we have agreed otherwise with you. Under no circumstances will compensation costs be applied. However, the seller reserves the right to defer reimbursement until he has received the returned products or when the customer has provided proof that the product has indeed been reshipped, the date retained being then that of the first of these events. .
You will have to bear the direct costs of returning the goods.
Guarantee
All products have a one-year warranty from the date of purchase. This warranty covers manufacturing defects (the case, the mechanism as well as defects in material or workmanship). All other defects not mentioned below are not covered by the warranty. In order to obtain a replacement under the guarantee please complete our revocation form. Please provide your name, address, order number and a detailed description of the problem. Keep in mind that repairs, more particularly replacements, remain chargeable during the warranty period in the following cases:
negligence (blow, bump, break). Under the conditions described, this guarantee guarantees you a free replacement within the time allowed. All other claims of the customer do not fall within the guarantee.
Complaints
Please check the products upon receipt to ensure that they are undamaged and have been delivered to you correctly without error. If your order has ever been damaged during transport, please contact the delivery partner as soon as possible. If ever the product does not meet your expectations or you have received the wrong product, please contact our customer service within three days of receiving your product. For any information, question or advice, MOFT customer service is available to the customer by email at the following address contact@moft-bijoux.com from Monday to Friday from 8 a.m. to 5 p.m. Please provide us with your order number and the subject of your request to facilitate the processing of requests. If you return a product to us, please package it as if it were an undamaged product. If we ever receive a product in perfect condition from you, undamaged, delivery costs (at the actual amount) will be charged for the shipping costs. MOFT reserves the right to replace defective products with the same model. If the product is no longer available you will get a refund.
Personal data
The data communicated by the customer on the site, necessary for the processing and delivery of orders, are exclusively reserved for MOFT or its partners when the customer has expressed his express consent to such use of his data. The customer has a right to access, modify, rectify and delete data concerning him. MOFT uses Cookies to optimize the use of the website.
Limitation of Liability
Placing an order implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the Internet network. Consequently, MOFT cannot, under any circumstances, be held responsible for any direct or indirect damage resulting from an interruption, a malfunction of any kind, or any direct or indirect damage which would result from any way, from a connection to the site. It is up to any person connecting to the site to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack. The connection of any person to the site is under his full responsibility.
force majeure
In the event of force majeure as defined by current case law, the performance of MOFT's services will be suspended in whole or in part. Force majeure means any external, unforeseeable and insurmountable event preventing MOFT from performing its contractual obligations. In the event of the occurrence of an event qualified as force majeure according to the preceding paragraph, MOFT undertakes to notify the customer as soon as possible.
Intellectual property rights
All elements of the site, whether visual or audio, including the underlying technology, are the exclusive property of MOFT and benefit from both copyright protection and the protection conferred by the provisions relating to the right trademarks and/or patents. The total or partial reproduction of any of these elements, on any medium whatsoever and for any reason whatsoever, without the prior and express agreement of MOFT is strictly prohibited.
Disputes - applicable law
These general conditions of sale are governed by French law. Any dispute that may arise between the Parties as a result of the formation, interpretation and/or execution of these presents will, failing amicable settlement, fall under the exclusive jurisdiction of the French courts.
